Responsible for providing guidance on a variety of labor and employment issues that arise from day-to-day operations of the company.
Responsibilities
Handles labor and employment cases, and whenever necessary, civil and criminal issues, including managing legal costs to ensure effective use of resources.Provides guidance / renders legal opinion to the Company regarding employment and human resources issues, and labor matters including policies and procedures.Supervises or oversees the conduct of administrative cases or complaints relative to the violations of company policy or related issues to be conducted / facilitated by the MOCOD and PCOD.Drafts policies and company procedures.Represents the company on legal issues/concerns before the Courts and quasi-judicial government agencies, and other regulatory agencies.Maintains professional and technical knowledge and keeping abreast on legal and labor and employment issues.Advises business units on employment compliance and risk management in order to accomplish business objectives without undue risk.Liaises with the Company’s Corporate Compliance Officer on legal matters arising from labor and employment related contracts and policies.Provides the Company, particularly top and middle management, of legal updates and labor and employment advisories that can possibly impact the company’s operations and compliance with requirements.Keeps Management abreast of significant labor and employment related decisions, legislations and regulatory rulings that may affect the Company’s business or policy.Drafts, reviews, analyzes and negotiates employment and construction (labor) related agreements including consulting, severance, incentive, noncompetition and confidentiality agreements among others (target is for contracts and legal documents to be 100% compliant with the existing laws and policies).Provides training to everyone, particularly those deployed in the project, on topics regarding labor and employment and other legal issues that they normally encounter in their day-to-day operations.Coaches and guides subordinate towards the achievement of their fullest potentials.Ensures that subordinates behave in a highly professional manner.Attends all available developmental courses being offered by the company to ensure his professional development and enhancement.Develops a thorough understanding and familiarity with the Company’s business, its people, markets, facilities, customers and competitors in order to identify trends and formulate appropriate structures and strategies.Ensures that case trackers and monitors, in coordination with the paralegal / legal assistant, are accurate and updated.Gathers all important and critical data in all the previous cases lodged against the company.Analyses these data in coordination with the Legal Counsel for Labor-Legal, to establish trends, projections and historical data that can be used to ensure that the interest of the company will be safeguarded.Provides analysis / strategies and counsels on legal and policy issues;Ensures that all transactions and agreements made by the company and client are within the framework of law. Anticipates and guards against legal risks facing the company;Represents the company or its officials in various legal proceedings;Prepares contracts and reviews business documents;Writes and administers client contracts;Develops and recommends improvements on legal documents, contracts, forms, instruments;Writes reviews and edits reports, opinions, correspondence, articles and other documents;Prepares briefs and other legal documents;Undertakes research into a variety of legal issues, relevant laws, rules, regulations, orders;Develops a thorough understanding of familiarity with the Company’s business, its people, markets, facilities, customers and competitors in order to identify trends and formulate appropriate structures and strategies;Negotiates business agreements;Performs other tasks that may be assigned from time to time.Provides general legal support with emphasis on corporate, contracts, and regulatory requirements.
QualificationsEducation: Graduate of Bachelor of Laws from any reputable Law School and must have passed the Philippine Bar.Experience: Must have an experience for at least 10 years in the corporate settingLicense Required: Philippine Bar Pass.
